Making of the Constitution and Its Sources

What to remember

  • Constituent Assembly: first met 1946; Rajendra Prasad was its President; B. R. Ambedkar chaired the Drafting Committee.
  • Constitution adopted 1949, came into force 1950. Sachchidananda Sinha was the temporary (interim) President at the first meeting.
  • Ideas were borrowed: Britain (parliamentary system), USA (Fundamental Rights), Ireland (Directive Principles), Canada (strong Centre), Australia (Concurrent List), Soviet Union (Fundamental Duties).

The Constituent Assembly

The Constituent Assembly of India was set up in 1946. Its first meeting was also held in 1946. At that first meeting, Sachchidananda Sinha presided as the temporary (interim or provisional) President. Later Rajendra Prasad became the President of the Assembly. The Assembly met in the Constitution Hall in New Delhi.

The Objectives Resolution was moved in the Constituent Assembly in December 1946 and passed in January 1947. It set out the aims that later shaped the Preamble.

The Assembly finished its work and adopted the Constitution in 1949. The Constitution came into force in 1950. The same year, the Supreme Court of India and the Election Commission of India were established.

Committees and their heads

The Assembly worked through many committees. The Drafting Committee was set up in 1947 and chaired by B. R. Ambedkar. He was the first Chairman of the Drafting Committee. Rajendra Prasad chaired the Steering Committee and the Rules of Procedure Committee. A. V. Thakkar chaired the Sub-Committee on Excluded and Partially Excluded Areas (other than Assam).

B. N. Rau served as the Constitutional Adviser to the Constituent Assembly. Members named in the Drafting Committee include:

Note that Alladi Krishnaswami Ayyar is a Telugu member of the Drafting Committee. This is a favourite point for AP exams.

Article 292 deals with borrowing by the Union Government. Article 293 deals with borrowing by the States.

The Preamble and the 42nd Amendment

The Preamble gives the ideals of the Constitution. In the Berubari Union case (opinion given in 1960), the Court held that the Preamble is not a part of the Constitution. This view was changed later by other judgments.

The 42nd Amendment Act was passed in 1976. It is called the "mini Constitution". It added the words socialist and secular and also integrity to the Preamble. It also inserted the Fundamental Duties.

National Emergencies were proclaimed during the Chinese aggression (1962) and the Indo-Pakistan war (1971). The internal Emergency was proclaimed by the Indira Gandhi government in 1975.

Exam traps

  • Rajendra Prasad was the permanent President of the Assembly. Sachchidananda Sinha was only the temporary (interim) President at the first meeting.
  • B. R. Ambedkar chaired the Drafting Committee. B. N. Rau was the Constitutional Adviser. Do not mix them.
  • Adopted in 1949 but in force from 1950. Both years are asked.
  • The Assembly was established in 1946, while the Drafting Committee came in 1947.
  • Fundamental Rights come from the USA. Directive Principles come from Ireland. Fundamental Duties come from the Soviet Union.
  • Concurrent List is from Australia. Strong Centre and residuary powers are from Canada.
  • Part III is Fundamental Rights, Part IV is Directive Principles, and Part IVA is Fundamental Duties.
  • Fundamental Duties and the words socialist and secular came together in the 42nd Amendment (1976). The 44th Amendment (1978) removed the Right to Property from Fundamental Rights.

Reasoning:

  • 1. Ambedkar chaired the Drafting Committee. He did not preside over the Assembly, so (c) is out.
  • 2. B. N. Rau was the Constitutional Adviser. This is an advisory post, not a chair, so (d) is out.
  • 3. Rajendra Prasad was the President of the Assembly. The question says "temporary", which points to the interim post at the first meeting.
  • 4. Sachchidananda Sinha presided at the first meeting as temporary President, so (b) is correct.

Takeaway: When a stem says "temporary" or "first meeting", look for the interim chair, not the permanent President.

Case 2: Arrange in order: (A) Constitution comes into force (B) Drafting Committee set up (C) Constituent Assembly established (D) Constitution adopted.

Reasoning:

  • 1. The Assembly was established in 1946, so (C) is first.
  • 2. The Drafting Committee was set up in 1947, so (B) comes next.
  • 3. The Constitution was adopted in 1949, so (D) comes before (A).
  • 4. It came into force in 1950, so (A) is last. Order: C, B, D, A.

Takeaway: Learn the four years 1946, 1947, 1949, 1950 as one ladder and place each event on it.

Case 3: Which of these borrowings is NOT correctly matched? (a) Concurrent List - Australia (b) Directive Principles - Ireland (c) Fundamental Duties - United States (d) Strong Centre - Canada

Reasoning:

  • 1. Concurrent List is from Australia, so (a) is right.
  • 2. Directive Principles are from Ireland, so (b) is right.
  • 3. Strong Centre is from Canada, so (d) is right.
  • 4. Fundamental Duties are from the Soviet Union, not the United States. The United States gave Fundamental Rights.

Takeaway: In "which is NOT" questions, test each pair against the source table and stop at the first false pair.

Case 4: Which amendment added Fundamental Duties, and which one removed the Right to Property from Fundamental Rights?

Reasoning:

  • 1. Both changes happened in the late 1970s, so students mix them.
  • 2. The 42nd Amendment (1976) is the "mini Constitution". It added Fundamental Duties and the words socialist, secular and integrity.
  • 3. The 44th Amendment (1978) removed the Right to Property from Fundamental Rights.
  • 4. The year order helps: 1976 is earlier, so 42nd comes first and 44th second.

Takeaway: Pair each number with its year: 42 with 1976, 44 with 1978.
