Fundamental Rights and Duties

What to remember

  • Part III has the Fundamental Rights (justiciable). Part IVA, Article 51A, has the Fundamental Duties (non-justiciable), added by the 42nd Amendment in 1976.
  • Article 32 is the right to constitutional remedies. The Supreme Court issues writs under Article 32 and High Courts under Article 226.
  • Right to Property was removed from Fundamental Rights by the 44th Amendment (1978). It is now a legal right under Article 300A.

Meaning and origin

Fundamental Rights are in Part III of the Constitution. They are justiciable, which means a court can enforce them. The idea of Fundamental Rights comes from the United States. The Fundamental Rights Sub-Committee of the Constituent Assembly was chaired by J. B. Kripalani. The Advisory Committee on Fundamental Rights and Minorities was chaired by Vallabhbhai Patel. Gopinath Bordoloi and J. B. Kripalani were members of this Advisory Committee.

Article 12 defines "State". Article 13 says that laws inconsistent with Fundamental Rights are void to that extent.

Related laws: the Protection of Civil Rights Act (1955) deals with offences of untouchability. The Protection of Human Rights Act (1993) led to the National Human Rights Commission.

Right to education

Article 21A gives the right to education. The 86th Amendment Act (2002) made education a Fundamental Right for children aged 6 to 14. The Right to Education Act came in 2009. Court cases on the topic include Mohini Jain (right to education as part of the right to life) and Unni Krishnan (right to education up to 14 years). The Directive Principle in Article 41 speaks of the right to work, education and public assistance.

Writs

A writ is a court order. Article 32 allows the Supreme Court to issue writs. Article 226 gives High Courts the power to issue writs. Article 139 gives the Supreme Court power to issue certain writs for other purposes.

The 24th Amendment Act (passed 1971) dealt with Parliament's power to amend Fundamental Rights. The 1st Amendment placed laws in the Ninth Schedule. Article 31A saves laws on acquisition of estates. Article 31B validates laws placed in the Ninth Schedule.

Property and other rights outside Part III

Right to Property was a Fundamental Right earlier. The 44th Amendment (1978) removed it from Part III. It is now only a legal right under Article 300A. Right to Information, Right to Property and Right to Vote are described as legal or constitutional rights, not Fundamental Rights.

The Right to Information Act was enacted in 2005. It gives citizens access to government information. The Forest Rights Act (2006) gives forest land rights to forest-dwelling tribal communities. The National Commission for Protection of Child Rights was set up in 2007. The National Human Rights Commission is a statutory body, set up in 1993, with headquarters in New Delhi. Its first Chairperson was Ranganath Misra.

Fundamental Duties

Fundamental Duties are in Part IVA, Article 51A. They were inserted in 1976 by the 42nd Amendment. The idea comes from the Soviet Union. They are non-justiciable. Examples are respect for the National Flag and safeguarding public property.

How to study this chapter

Learn the six groups by their Article ranges first: 14 to 18, 19 to 22, 23 and 24, 25 to 28, 29 and 30, and 32. Then attach one key Article to each group. For equality, remember Article 17 (untouchability). For freedom, remember Article 21 (life and liberty). For exploitation, remember Article 24 (child labour). For religion, remember Article 25. For cultural rights, remember Article 30. For remedies, remember Article 32.

Rights are not unlimited. The State can place reasonable restrictions on them. The first amendment to the Constitution in 1951 added restrictions on free speech. Rights can be enforced directly in the Supreme Court under Article 32, which is why Article 32 is often called the heart of the rights chapter. High Courts can go further under Article 226, because they can issue writs for other purposes as well.

Duties remind citizens that rights come with responsibility. They are listed in Article 51A and are not enforced by courts. Respect for the National Flag and safeguarding public property are two standard examples.

Exam traps

  • Fundamental Rights are justiciable. Fundamental Duties and Directive Principles are non-justiciable.
  • Article 32 is for the Supreme Court. Article 226 is for High Courts.
  • Article 21 is life and liberty. Article 21A is education. Article 24 is child labour. Do not swap them.
  • Right to Equality is Articles 14 to 18. Freedom is 19 to 22. Religion is 25 to 28.
  • Right to Property is not a Fundamental Right now. It is under Article 300A.
  • Habeas Corpus is for illegal detention. Mandamus is a command to do a duty. Quo Warranto questions a claim to public office.
  • Fundamental Duties came through the 42nd Amendment (1976). The 44th Amendment (1978) removed the Right to Property.
  • Jurisdiction: the 86th Amendment gives free education for ages 6 to 14 only.

Reasoning:

  • 2. Habeas Corpus means "produce the detained person before the court". It is used against illegal detention.
  • 3. Mandamus orders a duty, Prohibition stops a lower court, Certiorari quashes an order, and Quo Warranto tests a claim to office. None of these fits.
  • 4. High Courts issue writs under Article 226. The Supreme Court does so under Article 32.

Takeaway: Name the problem first (detention, duty, jurisdiction, order, office), then pick the writ.
