Judiciary: Supreme Court and High Courts

What to remember

  • The Supreme Court of India was established in 1950, sits in New Delhi, and its first Chief Justice was H. J. Kania. Article 124 creates it; Article 214 creates High Courts.
  • Article 32 (Supreme Court) and Article 226 (High Courts) give the power to issue the five writs. Article 32 is itself a Fundamental Right.
  • Landmark cases decide the shape of the Constitution: Kesavananda Bharati (1973) gave the basic structure doctrine; Maneka Gandhi (1978) widened Article 21.

Background: how the court system grew

The modern court system began under British rule. The Regulating Act was passed in 1773. A Supreme Court was set up at Calcutta in 1774. The Indian High Courts Act of 1861 allowed High Courts in the provinces. Calcutta, Bombay and Madras High Courts were established in 1862. Allahabad High Court followed in 1866. The Federal Court of India was set up in 1937. Its first Chief Justice was Maurice Gwyer. After independence, the Supreme Court of India was inaugurated in 1950, and the Federal Court was replaced by it.

For Andhra Pradesh, two dates matter. The Andhra High Court at Guntur was established in 1954. The High Court of Andhra Pradesh at Amaravati was established in 2019.

Independence of the judiciary

Article 50 directs the State to separate the judiciary from the executive. The salaries of judges are fixed by the Second Schedule, which also covers the President and Governors. Article 125 deals with the salaries of Supreme Court judges and Article 221 with those of High Court judges. The Judges Inquiry Act 1968 lays down the inquiry into misbehaviour of a judge. The Contempt of Courts Act 1971 protects the dignity of courts. Article 129 makes the Supreme Court a court of record, and Article 215 does the same for High Courts.

The 99th Constitutional Amendment (2014) tried to bring in the National Judicial Appointments Commission through Article 124A. The Second Judges case of 1993 is also linked with the question of judicial appointments.

Article 138 deals with enlargement of jurisdiction and Article 139 with power to issue certain writs. Article 139A deals with the transfer of cases. Article 144 requires civil authorities to act in aid of the Supreme Court. Article 147 deals with interpretation of the Constitution.

Article 131 gives original jurisdiction, mainly in disputes between the Union and States. Article 143 lets the President seek the court's opinion. The Berubari Union opinion of 1960 was given under this kind of reference. Article 71 puts disputes about the election of the President before the Supreme Court. Article 262 deals with adjudication of inter-state water disputes.

High Courts and subordinate courts

Article 214 provides a High Court for each state. Article 216 deals with the constitution of High Courts. Article 217 deals with the appointment of High Court judges, and Article 222 with their transfer. Article 231 allows a common High Court for two or more states. Article 226 gives High Courts power to issue writs. Its range is wider than Article 32, because High Courts can issue writs for ordinary legal rights as well as Fundamental Rights.

Article 227 gives each High Court superintendence over subordinate courts. Article 233 deals with the appointment of district judges and Article 235 with control over the subordinate courts. Article 323A and Article 323B allow tribunals. The L. Chandra Kumar case (1997) is the case on judicial review powers of tribunals.

Article 32 is the right to constitutional remedies. It is known as the heart and soul of the Constitution. Article 13 declares laws that are inconsistent with Fundamental Rights void. Article 39A speaks of equal justice and free legal aid.

The Mohini Jain case also treated the right to education as part of the right to life. Article 21A now gives the right to education. Articles 14, 20, 21 and 22 are the main articles on equality, protection in conviction, life and liberty, and arrest and detention.

Related laws and bodies

The Legal Services Authorities Act 1987 provides free legal aid and Lok Adalats. The National Legal Services Authority was formed in 1995. The Gram Nyayalayas Act 2008 sets up village-level courts. The Family Courts Act 1984 settles family disputes. The Arbitration and Conciliation Act 1996 supports alternative dispute resolution. Tribunals include the Central Administrative Tribunal (1985), Armed Forces Tribunal (2009), National Green Tribunal (2010) and National Company Law Tribunal (2016). The first woman judge of the Supreme Court was Fathima Beevi. The Bharatiya Nyaya Sanhita was enacted in 2023; earlier laws were the Indian Penal Code (1860), Indian Evidence Act (1872) and Code of Criminal Procedure (1973), replaced by the BNS, BSA and BNSS.

Exam traps

  • Article 32 is for the Supreme Court and only for Fundamental Rights. Article 226 is for High Courts and has a wider range.
  • Article 124 creates the Supreme Court; Article 214 creates High Courts; Article 129 and Article 215 are the "court of record" Articles.
  • Golaknath (1967) said Fundamental Rights cannot be amended. Kesavananda Bharati (1973) allowed amendment but not of the basic structure.
  • Shankari Prasad (1951) is the first amendment-power case; do not mix it with Shah Bano (1985).
  • Mandamus commands a duty; Prohibition stops a lower court before it acts; Certiorari quashes an order after it is passed.
  • Calcutta, Bombay and Madras High Courts are 1862; Allahabad is 1866.
  • Article 141 (law binding) is different from Article 142 (complete justice) and Article 143 (advisory).
  • Do not confuse the Federal Court (1937) with the Supreme Court (1950).

Worked cases

Case 1: Which of the following is NOT a power given by Article 226 or Article 32? (a) Habeas Corpus (b) Quo Warranto (c) Advisory opinion to the President (d) Certiorari

Reasoning:

  • 1. Articles 32 and 226 are the writ Articles. The five writs are Habeas Corpus, Mandamus, Prohibition, Certiorari and Quo Warranto.
  • 2. Options (a), (b) and (d) are all among the five writs, so they cannot be the answer.
  • 3. Advisory opinion is a different power. It comes from Article 143, which lets the President seek the Supreme Court's opinion.
  • 4. So the odd one out is (c).

Takeaway: When a question says "NOT", first list the five writs, then remove every option that is on the list.

Case 2: Arrange in order of year: Kesavananda Bharati, Golaknath, Maneka Gandhi, Minerva Mills.

Reasoning:

  • 1. Start with the cases that have a clear link. Golaknath (1967) said Parliament cannot amend Fundamental Rights.
  • 2. Kesavananda Bharati (1973) came next and gave the basic structure doctrine. It is the answer to Golaknath's strict view.
  • 3. Maneka Gandhi is 1978 and widened Article 21.
  • 4. Minerva Mills is 1980. It deals with the balance between Fundamental Rights and Directive Principles, so it comes after the basic structure idea.
  • 5. The order is Golaknath, Kesavananda Bharati, Maneka Gandhi, Minerva Mills.

Takeaway: Link each case to its idea. The ideas build on each other, so the years are easier to remember.

Case 3: A lower court is about to hear a case outside its power. Which writ stops it? What if the order is already passed?

Reasoning:

  • 1. The question is about timing. Ask: has the order been made yet?
  • 2. If the court is still hearing the case, Prohibition stops it from going beyond its jurisdiction.
  • 3. If the order is already passed, Certiorari quashes the order of the lower court.
  • 4. Mandamus is for a public official's duty, so it does not fit. Habeas Corpus is for a detained person, so it also does not fit.

Takeaway: Prohibition acts before the order. Certiorari acts after the order.

Case 4: Match: Article 141, Article 142, Article 143 with (i) complete justice (ii) advisory jurisdiction (iii) law declared is binding.

Reasoning:

  • 1. Take the Article you know best. Article 143 is advisory jurisdiction, so 143 matches (ii).
  • 2. Article 141 says the law declared by the Supreme Court is binding, so 141 matches (iii).
  • 3. The one left is Article 142, which is complete justice, matching (i).
  • 4. Check the neighbours: Article 136 is special leave to appeal and Article 137 is review of judgments, so they are not part of this set.

Takeaway: In a three-way match, fix the Article you are sure about and use elimination for the rest.
