What to remember

  • Part XI covers Centre-State relations and Part XVIII covers Emergency. Article 352 is National Emergency, Article 356 is President's rule, Article 360 is Financial Emergency.

The schedules

The schedules are lists attached to the Constitution. They are asked in every exam.

The Ninth Schedule was added by the First Constitutional Amendment (1951), which also placed restrictions on freedom of speech. Article 31A saves laws that provide for acquisition of estates. Article 31B validates the laws placed in the Ninth Schedule. In the I. R. Coelho case (2007), the Supreme Court reviewed Ninth Schedule laws.

Eleventh and Twelfth Schedule subjects

Eleventh Schedule (panchayats) includes: minor irrigation, watershed development, social forestry, fisheries, animal husbandry, minor forest produce, khadi, village and cottage industries, rural housing, drinking water, rural electrification, non-conventional energy, libraries, markets and fairs, the public distribution system, maintenance of community assets, family welfare, women and child development, adult and non-formal education, technical and vocational education, and land consolidation and soil conservation.

Twelfth Schedule (municipalities) includes: urban planning including town planning, regulation of land use and building construction, planning for economic and social development, water supply for domestic, industrial and commercial purposes, fire services, urban forestry, slum improvement and upgrading, urban poverty alleviation, parks, gardens and playgrounds, street lighting, public conveniences, burial and cremation grounds, cattle pounds, registration of births and deaths, regulation of slaughterhouses and tanneries, solid waste management, and safeguarding the interests of weaker sections.

Tribal and weaker-section provisions

Article 244 provides for the administration of Scheduled Areas. The Fifth Schedule applies to Scheduled Areas and Scheduled Tribes; the Sixth Schedule to tribal areas of the north-east. Article 243M says panchayat provisions do not apply to Scheduled and tribal areas. The Panchayats (Extension to Scheduled Areas) Act of 1996 extends them with self-governance. Article 341 specifies Scheduled Castes and Article 342 specifies Scheduled Tribes. Articles 330 and 332 reserve Lok Sabha and Assembly seats for SCs and STs. Article 335 deals with their claims to services. Article 338 is the National Commission for SCs and Article 338A the Commission for STs (established 2004 after the 89th Amendment). The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act was passed in 1989.

Three proclamations of National Emergency are noted. One was during the Chinese aggression in 1962. Another was during the Indo-Pakistan war in 1971. The internal Emergency was proclaimed by the Indira Gandhi government in 1975. The 42nd Amendment was passed in 1976 and the 44th in 1978; both dealt with the Emergency period changes. The suspension of Fundamental Rights during Emergency is an idea associated with Germany. The Shah Commission on Emergency excesses was chaired by J. C. Shah.

The S. R. Bommai case (1994) allowed judicial review of the use of President's rule. Article 356 is based on the report of the Governor or the President's own satisfaction.

Federalism and Centre-State relations

Part XI of the Constitution covers relations between the Union and the States. The Seventh Schedule distributes powers between them. The idea of a federation with a strong Centre, and of residuary powers with the Centre, is associated with Canada. Article 3 allows Parliament to form new States and alter boundaries. Article 301 gives freedom of trade, commerce and intercourse. Article 312 provides for All-India Services and Article 311 protects civil servants against arbitrary dismissal. Article 343 deals with the official language of the Union. Part VIII deals with Union Territories.

The Sarkaria Commission (1983) and the Punchhi Commission (2007), chaired by M. M. Punchhi, studied Centre-State relations. Article 263 provides for the Inter-State Council.

Special provisions

Article 370 gave a special status to Jammu and Kashmir. Article 371D gives equal opportunity in public employment and education in Andhra Pradesh. Article 371E deals with a Central University in Andhra Pradesh. Article 30 gives minorities the right to run educational institutions. Article 300A is the right to property. Article 326 provides adult suffrage. Article 32 is the right to constitutional remedies.

Reading the Seventh Schedule

The Seventh Schedule has three lists. The Union List covers national subjects, and Parliament alone makes laws on it. The State List covers subjects such as agriculture, irrigation, land, fisheries, police and public health. The Concurrent List is shared by both. Residuary powers go to the Centre, which is a feature associated with Canada. During a National Emergency, Parliament can legislate on State List subjects (Article 250). The Union also has a duty under Article 355 to protect every State. If a State does not follow Union directions, Article 365 applies. These rules show why India is called a federation with a strong Centre.

Reading the Emergency Articles together

Article 352 deals with a National Emergency, Article 356 with a State's constitutional failure and Article 360 with a Financial Emergency. Remember them as 3-5-6 and 3-6-0 patterns: 352, 356, 360. Fundamental Rights under Article 32 can be affected in an Emergency, which is why the 44th Amendment (1978) matters. The Emergency of 1975 is the best known and appears in many questions with the 42nd Amendment of 1976.

Exam traps

  • Fifth Schedule is for Scheduled Areas anywhere; Sixth Schedule is for the north-east tribal areas.
  • Ninth Schedule protects laws from judicial review but the 2007 Coelho case reviewed them.
  • Tenth Schedule is anti-defection; Eighth Schedule is languages.
  • Article 352 is National Emergency; Article 356 is a state breakdown; Article 360 is financial.
  • Article 371D is Andhra Pradesh; Article 371E is the Central University.
  • The 1962 and 1971 Emergencies were external; the 1975 one was internal.
  • Article 338 (SC) and Article 338A (ST) are different Commissions.
  • Article 341 specifies SCs and 342 specifies STs.

Reasoning:

  • 1. Check each pair against what you know. The Fourth Schedule allocates Rajya Sabha seats, so (a) is correct.
  • 2. The Ninth Schedule protects laws from judicial review, so (b) is correct.
  • 3. The Third Schedule has the forms of oaths and affirmations, so (d) is correct.
  • 4. Anti-defection is the Tenth Schedule. The Eighth Schedule is the list of languages. So (c) is wrong.

Takeaway: Tenth is "ten = defection law". Eighth is languages. Never swap them.

Case 2: A State Assembly can no longer work, and the President takes over the State. Which Article applies, and which case allows courts to review it?

Reasoning:

  • 1. Failure of constitutional machinery in a State means President's rule.
  • 2. Article 352 is National Emergency, and Article 360 is Financial Emergency. Neither is for one State.
  • 3. So Article 356 applies.
  • 4. The S. R. Bommai case (1994) allowed judicial review of the use of President's rule.

Takeaway: Use the 352-356-360 pattern. The middle one (356) is the State one.

Case 3: Arrange these in order: the Emergency of 1975, the 44th Amendment, the 42nd Amendment, the Emergency during the Indo-Pakistan war.

Reasoning:

  • 1. The Emergency linked with the Indo-Pakistan war was proclaimed in 1971. This is earliest.
  • 2. The internal Emergency by the Indira Gandhi government was proclaimed in 1975.
  • 3. The 42nd Amendment was passed in 1976, after the Emergency began.
  • 4. The 44th Amendment was passed in 1978.
  • 5. The order is 1971 war Emergency, 1975 Emergency, 42nd, 44th.

Takeaway: Three Emergencies are 1962, 1971 and 1975. The two amendments follow in 1976 and 1978.

Case 4: Which of these subjects belongs to the Twelfth Schedule and not the Eleventh? (a) Fisheries (b) Fire services (c) Social forestry (d) Libraries

Reasoning:

  • 1. Think about who handles the subject. Rural subjects go to panchayats, urban ones to municipalities.
  • 2. Fisheries, social forestry and libraries are listed in the Eleventh Schedule for panchayats.
  • 3. Fire services is listed in the Twelfth Schedule for municipalities.
  • 4. Note the near-match: urban forestry is Twelfth, while social forestry is Eleventh.
  • 5. The answer is (b).

Takeaway: Ask "village or town?" and watch look-alike pairs such as social forestry and urban forestry.
