Constitutional and Statutory Provisions for SC, ST, BC, Minorities and Disabled

What to remember

  • Equality with protection: Articles 14-16 give equality, and Articles 15(4), 15(5), 16(4) allow special help for backward groups. Article 17 abolishes untouchability.
  • Special bodies: Article 338 (NCSC), 338A (NCST) and 338B (NCBC) create national commissions. Article 244 gives special rules for Scheduled and Tribal Areas through the Fifth and Sixth Schedules.
  • Reservation has limits: The Supreme Court (Indra Sawhney case) set a general cap of 50 per cent and applied the creamy layer rule to OBCs. The RPwD Act 2016 is the main law for persons with disabilities.

Fundamental rights that protect weaker sections

Article 14 gives equality before law. Article 15(1) bans discrimination on grounds of religion, race, caste, sex or place of birth. Article 15(2) bars denial of access to shops, restaurants, wells, roads and places of public resort.

Article 15(3) allows special provisions for women and children. Article 15(4) allows special provisions for socially and educationally backward classes, SCs and STs. It was added by the First Amendment (1951) after the Champakam Dorairajan case. Article 15(5), added by the 93rd Amendment (2005), allows reservation in admission to educational institutions, including private unaided ones, but not minority institutions. Article 15(6), added by the 103rd Amendment (2019), allows reservation for economically weaker sections (EWS) among those not covered by existing reservations.

Article 16(1) gives equality of opportunity in public employment. Article 16(4) allows reservation in posts for backward classes not adequately represented. Article 16(4A) allows reservation in promotion for SCs and STs (77th Amendment). Article 16(4B) allows carry-forward of unfilled vacancies (81st Amendment). Article 16(6) allows EWS reservation in posts.

Article 17 abolishes untouchability, and its practice is a punishable offence. Article 23 bans forced labour and trafficking. Article 24 bans child labour in factories and mines. Article 29 protects the language, script and culture of any section of citizens. Article 30 gives minorities the right to set up and run educational institutions. Article 21A gives free and compulsory education for children aged 6-14.

Directive principles and other provisions

Article 46 directs the State to promote the educational and economic interests of SCs, STs and other weaker sections and protect them from social injustice. Article 335 says the claims of SCs and STs to services must be considered while keeping administrative efficiency. Articles 330 and 332 reserve seats for SCs and STs in the Lok Sabha and State Assemblies. Articles 243D and 243T reserve seats in Panchayats and Municipalities. Article 350A asks States to provide primary education in the mother tongue for linguistic minorities. Article 350B provides a Special Officer for linguistic minorities. Articles 341 and 342 let the President notify the lists of Scheduled Castes and Scheduled Tribes. Article 340 provides for a commission to study backward classes.

Scheduled and Tribal Areas

Article 244(1) applies the Fifth Schedule to Scheduled Areas and Scheduled Tribes in all States except Assam, Meghalaya, Tripura and Mizoram. Article 244(2) applies the Sixth Schedule to those four States, through Autonomous District Councils. Andhra Pradesh has Scheduled Areas under the Fifth Schedule. A Tribes Advisory Council advises the Governor. The Governor can make regulations to stop transfer of tribal land. Article 275(1) gives grants-in-aid for tribal welfare.

Related laws: the PESA Act 1996 gives Gram Sabhas special powers in Scheduled Areas. The Forest Rights Act 2006 recognises forest rights of tribal and other forest dwellers. In Andhra Pradesh Scheduled Areas, a land transfer regulation (known as the 1/70 rule) bans transfer of tribal land to non-tribals. Integrated Tribal Development Agencies (ITDAs) carry out tribal development work.

Each of these bodies investigates complaints, monitors safeguards and advises the government. The NCSC and NCST have powers of a civil court while inquiring. Andhra Pradesh also has State level commissions for SCs, BCs and minorities.

Atrocities and welfare laws

  • Protection of Civil Rights Act 1955: It was first passed as the Untouchability (Offences) Act 1955 and renamed in 1976. It punishes practice of untouchability.
  • SC/ST (Prevention of Atrocities) Act 1989: It punishes crimes against SCs and STs, creates Special Courts and provides relief to victims. It was strengthened by amendments (2015 and 2018).
  • Manual Scavengers Act 2013: It bans manual scavenging and insanitary latrines and provides rehabilitation.
  • Bonded Labour System (Abolition) Act 1976: It abolishes bonded labour.

Backward Classes, creamy layer and the 50 per cent rule

The Mandal Commission (appointed 1979) recommended 27 per cent reservation for OBCs. In Indra Sawhney v. Union of India, the Supreme Court upheld the 27 per cent OBC reservation. It also set a general ceiling of 50 per cent, excluded the creamy layer of OBCs, and said reservation applies at initial appointment only. The 77th Amendment later allowed reservation in promotion for SCs and STs. The creamy layer rule applies to OBCs and not to SCs and STs. It is decided on social position and income criteria set by the government.

In Andhra Pradesh, Backward Classes are grouped into categories (A to E) for reservation. The BC Welfare Department, SC Welfare and Tribal Welfare departments run hostels, scholarships and loans. Corporations and finance bodies give loans for self-employment. After a 2024 Supreme Court judgment, States can consider sub-classification within Scheduled Castes, with proper data.

Minorities

Six communities are notified as national minorities: Muslims, Christians, Sikhs, Buddhists, Parsis (Zoroastrians) and Jains (Jains were added in 2014). The Ministry of Minority Affairs was created in 2006. Article 30 protects their educational institutions. Scholarships and skill programmes help minority students. The Waqf Act governs Waqf property. Andhra Pradesh has a Minorities Welfare Department, a Minorities Commission and a Waqf Board.

Persons with disabilities

The Rights of Persons with Disabilities (RPwD) Act 2016 replaced the Persons with Disabilities Act 1995. It follows the UN Convention on the Rights of Persons with Disabilities. Main points:

  • It recognises 21 types of disabilities.
  • "Person with benchmark disability" means at least 40 per cent of a specified disability.
  • It gives 4 per cent reservation in government posts and 5 per cent in higher education seats for benchmark disabilities.
  • It provides accessibility, guardianship support, special courts and punishment for discrimination and offences.
  • It sets up a Chief Commissioner and State Commissioners.

Other laws: the Rehabilitation Council of India Act 1992 regulates training of rehabilitation professionals; the National Trust Act 1999 covers autism, cerebral palsy, intellectual disability and multiple disabilities; the Mental Healthcare Act 2017 protects the rights of persons with mental illness. A national identity card for disability (UDID) is used to access benefits. The Accessible India Campaign (Sugamya Bharat Abhiyan) works for barrier-free access.
