NEW DELHI, October 7 — A three-judge bench of the Supreme Court of India on Wednesday delivered a comprehensive procedural ruling strengthening oversight frameworks governing police encounters and extra-judicial deaths, augmenting the binding guidelines originally laid down in PUCL v. State of Maharashtra (2014).

Under the fortified Standard Operating Procedure (SOP), the apex court mandated that every death occurring in a police encounter must trigger an immediate statutory First Information Report (FIR) and an independent magisterial inquiry conducted by a Judicial or Metropolitan Magistrate under Section 196 of the Bharatiya Nagarik Suraksha Sanhita (BNSS, 2023; erstwhile Section 176 CrPC), to be concluded within a strict ninety-day statutory deadline. The substantive investigation must be transferred to an independent agency, such as the state CID or a court-monitored Special Investigation Team (SIT).

The bench categorically barred the conferring of any gallantry citations, monetary rewards, or out-of-turn promotions to involved police personnel until the conclusion of the magisterial inquiry conclusively establishes that the lethal force was strictly justified under the exception of private defence. Furthermore, state police chiefs are statutorily obligated to submit initial incident reports to the National Human Rights Commission (NHRC) within 48 hours of any fatal police shooting.

Constitutional protections under Article 21 (Right to Life and Personal Liberty), the jurisprudence of encounter killings (PUCL 2014 precedent), police accountability mechanisms, and the powers of the NHRC under the Protection of Human Rights Act 1993 are foundational topics in UPSC Civil Services (GS-II: Fundamental Rights & Police Reforms) and judicial services examinations. नई दिल्ली, 7 अक्टूबर — भारत के सर्वोच्च न्यायालय की तीन-न्यायाधीशों की पीठ ने पुलिस मुठभेड़ों (Encounters) और पुलिस हिरासत में होने वाली मौतों की जांच प्रक्रिया को पूरी तरह पारदर्शी और जवाबदेह बनाने के उद्देश्य से पीयूसीएल बनाम महाराष्ट्र राज्य (2014) के ऐतिहासिक दिशानिर्देशों को और अधिक सुदृढ़ करते हुए नए अनिवार्य मानक संचालन प्रक्रिया (SOP) जारी किए हैं।

शीर्ष अदालत ने फैसला सुनाते हुए निर्देश दिया कि प्रत्येक मुठभेड़ में हुई मौत के मामले में भारतीय नागरिक सुरक्षा संहिता (BNSS) की धारा 196 (पूर्ववर्ती CrPC धारा 176) के तहत एक स्वतंत्र न्यायिक या मेट्रोपॉलिटन मजिस्ट्रेट द्वारा अनिवार्य जांच तीन महीने के भीतर पूरी की जानी चाहिए। इसके अलावा, मामले की प्राथमिकी (FIR) तुरंत दर्ज की जानी चाहिए और जांच संबंधित पुलिस स्टेशन से स्वतंत्र एक विशेष अपराध शाखा (CID या SIT) को सौंपी जानी चाहिए।

पीठ ने स्पष्ट किया कि जब तक मजिस्ट्रियल जांच या स्वतंत्र जांच दल द्वारा मुठभेड़ को वास्तविक आत्मरक्षा (Private Defence) साबित नहीं कर दिया जाता, तब तक किसी भी पुलिस अधिकारी को कोई वीरता पुरस्कार या आउट-ऑफ-टर्न पदोन्नति नहीं दी जाएगी। इसके साथ ही, घटना के 48 घंटों के भीतर राष्ट्रीय मानवाधिकार आयोग (NHRC) या राज्य मानवाधिकार आयोग (SHRC) को अनिवार्य लिखित रिपोर्ट प्रस्तुत करना कानूनी रूप से बाध्यकारी होगा।

अनुच्छेद 21 (जीने का अधिकार), पीयूसीएल बनाम महाराष्ट्र राज्य मामला (2014), भारतीय नागरिक सुरक्षा संहिता (BNSS 2023) के तहत मजिस्ट्रियल जांच, पुलिस सुधार, और राष्ट्रीय मानवाधिकार आयोग की शक्तियां यूपीएससी सिविल सेवा (GS-II: शासन एवं न्यायपालिका) और सभी न्यायिक सेवा परीक्षाओं के लिए अत्यंत महत्वपूर्ण हैं। अभ्यर्थियों को याद रखना चाहिए कि संविधान के अनुच्छेद 21 के तहत विधि द्वारा स्थापित प्रक्रिया के बिना किसी भी व्यक्ति को उसके जीवन या व्यक्तिगत स्वतंत्रता से वंचित नहीं किया जा सकता है, और पुलिस को कानून के दायरे से बाहर जाकर सजा देने का कोई अधिकार नहीं है।
