NEW DELHI, October 9 — A five-judge Constitution Bench of the Supreme Court of India on Friday unanimously dismissed review petitions challenging its landmark judgment that struck down the Electoral Bond Scheme (2018) as unconstitutional and violative of voters’ fundamental rights.

In its reasoned order, the bench affirmed that the voter’s 'Right to Information' regarding political funding sources constitutes a non-negotiable core of democratic representation anchored under Article 19(1)(a) of the Constitution. The Court reiterated that anonymized corporate donations undermine level playing fields, skew policy formulation through potential quid pro quo arrangements, and breach the basic structure doctrine.

Reaffirming regulatory boundaries, the apex court directed the Election Commission of India (ECI) to maintain rigorous compliance audits across the Electoral Trusts Scheme 2013, mandating real-time quarterly disclosures of all corporate donations channeled to political parties alongside stringent reporting standards under Section 29C of the Representation of the People Act, 1951.

Constitutional jurisprudence under Article 19(1)(a) versus Article 21, Constitution Benches (Article 145(3)), the Representation of the People Act 1951 (Section 29C disclosure thresholds), Section 182 of the Companies Act 2013 governing corporate contributions, and landmark electoral reform committee reports (Indrajit Gupta Committee 1998, Law Commission 255th Report) are fundamental pillars for UPSC Civil Services (GS-II: Polity, Governance, and Election Reforms).
